Terms of Service

Effective: March 24, 2026

These Terms of Service (“Terms”) govern your use of the TapVend platform operated by TapVend LLC (“we,” “us,” or “TapVend”), a Utah limited liability company. By accessing or using TapVend, you agree to these Terms.

1. Service Overview

TapVend is a mobile-first point-of-sale and ticketing platform for food trucks, vendors, pop-up events, and traveling shows. We provide online ordering storefronts, order management dashboards, in-person Tap to Pay card payments via the TapVend Vendor mobile app, ticket scanning, and payment processing via Stripe Connect.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use TapVend. By creating an account, you represent that you meet these requirements.

3. Accounts

You are responsible for maintaining the security of your account and for all activity under your account. You must provide accurate and complete information when creating an account. Notify us immediately at support@tapvend.app if you suspect unauthorized access.

4. Pricing & Fees

TapVend is free to set up and use. There are no monthly fees or subscriptions.
TapVend charges a 3.5% platform fee per transaction, deducted automatically from each sale.
Stripe’s standard processing fees apply separately and are charged by Stripe, not TapVend. These are currently 2.9% + 30¢ for online payments and 2.6% + 10¢ for in-person (Terminal) payments, but may change per Stripe’s pricing.
The 3.5% TapVend fee is passed to customers as a service fee at checkout.

We reserve the right to change pricing with 30 days’ notice. Account holders will be notified by email before any price change takes effect.

5. Payments & Stripe Connect

All payment processing is handled through Stripe Connect. As a vendor, you connect your own Stripe account and are subject to Stripe’s Connected Account Agreement. TapVend does not store credit card information. Refunds and disputes are processed through Stripe according to their policies.

6. Vendor Responsibilities

Vendors using TapVend agree to:

Provide accurate product descriptions and pricing.
Fulfill orders in a timely manner.
Comply with all applicable local health, safety, and business regulations.
Not use the platform for illegal, fraudulent, or prohibited activities.

7. Customer Orders

When a customer places an order through a TapVend storefront, the transaction is between the customer and the vendor. TapVend facilitates the technology and payment processing but is not a party to the sale. Vendors are responsible for order fulfillment, food quality, and customer service.

8. Intellectual Property

The TapVend name, logo, and platform are the property of TapVend LLC. You retain ownership of any content you upload (logos, product images, descriptions). By uploading content, you grant TapVend a non-exclusive license to display it on the platform as needed to provide the service.

9. Limitation of Liability

TapVend is provided “as is” without warranties of any kind. To the maximum extent permitted by law, TapVend LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the fees you paid to TapVend in the 12 months preceding the claim.

10. Termination

Either party may terminate the relationship at any time. You may close your account by contacting support@tapvend.app. We may suspend or terminate your account for violations of these Terms. Upon termination, your data will be retained for 30 days before deletion, unless required by law to retain it longer.

11. Governing Law

These Terms are governed by the laws of the State of Utah. Any disputes shall be resolved in the courts located in Cache County, Utah.

12. Changes to Terms

We may update these Terms from time to time. Continued use of TapVend after changes are posted constitutes acceptance. Material changes will be communicated via email.
